L&rsquo;Indice ILAT est un indice officiel, publi\u00e9 trimestriellement par l&rsquo;Institut National de la Statistique et des \u00c9tudes \u00c9conomiques (INSEE).<\/p><p><span style=\"background-color: var(--theme-body-bg-color); color: var(--theme-body-font-color);\">Il s\u2019est substitu\u00e9 \u00e0 l\u2019Indice du Co\u00fbt de la Construction (ICC) depuis la loi Pinel du 18 juin 2014 qui impose le choix de cet indice pour tout nouveau bail \u2013 ou renouvellement de bail \u2013 \u00e0 compter du 1<\/span><sup style=\"background-color: var(--theme-body-bg-color); color: var(--theme-body-font-color);\">er<\/sup><span style=\"background-color: var(--theme-body-bg-color); color: var(--theme-body-font-color);\">septembre 2014. Il est alors utilis\u00e9 pour r\u00e9viser le montant des loyers des immeubles de bureaux et des locaux professionnels destin\u00e9s \u00e0 des activit\u00e9s tertiaires.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-2e43ba1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2e43ba1\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-1722574\" data-id=\"1722574\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-dfc43dc elementor-widget elementor-widget-heading\" data-id=\"dfc43dc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><p><b><span style=\"font-size:16.0pt;line-height:107%\">L\u2019ILAT est directement li\u00e9 \u00e0 l\u2019inflation, aux co\u00fbts de construction ainsi qu\u2019\u00e0 d\u2019autres facteurs  \u00e9conomiques<\/span><\/b><span style=\"color: var(--theme-heading-font-color);font-size: var(--theme-h2-font-size);font-weight: var(--theme-heading-font-weight);background-color: var(--theme-body-bg-color)\"><\/span><\/p><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-78ff53d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"78ff53d\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-72d83c6\" data-id=\"72d83c6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f331c3f elementor-widget elementor-widget-text-editor\" data-id=\"f331c3f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"background-color: var(--theme-body-bg-color); color: var(--theme-body-font-color);\">Pour comprendre les raisons de cette nouvelle hausse, il convient de s&rsquo;int\u00e9resser \u00e0 la composition de l&rsquo;indice.<\/span><\/p><p><span style=\"background-color: var(--theme-body-bg-color); color: var(--theme-body-font-color);\">L&rsquo;ILAT correspond \u00e0 la somme pond\u00e9r\u00e9e de trois autres indices \u00e9galement publi\u00e9s par l\u2019INSEE\u00a0:<\/span><\/p><p>&#8211; l&rsquo;indice des prix \u00e0 la consommation (hors tabac et loyers) pour l&rsquo;ensemble des m\u00e9nages fran\u00e7ais pour 50%<\/p><p>&#8211; l&rsquo;indice du co\u00fbt de la construction (ICC) pour 25%<\/p><p>&#8211; le niveau du PIB (Produit Int\u00e9rieur Brut) corrig\u00e9 des variations saisonni\u00e8res et des jours ouvrables pour 25%<\/p><p>Vue la progression persistante des prix \u00e0 la consommation des m\u00e9nages et du prix des mati\u00e8res premi\u00e8res dans le contexte inflationniste actuel, l\u2019ILAT augmente m\u00e9caniquement. Mais jusque qu\u2019\u00e0 quand ? Seule un net recul de l\u2019inflation permettra d\u2019envisager un retour de l\u2019indice sur des valeurs plus mod\u00e9r\u00e9es.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-62a4ae8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"62a4ae8\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b0a2fac\" data-id=\"b0a2fac\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a6904ae elementor-widget elementor-widget-heading\" data-id=\"a6904ae\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><p><b><span style=\"font-size:16.0pt;line-height:107%\">La hausse de l'ILAT se r\u00e9percute pleinement sur les loyers qui progressent bien plus vite que les valeurs locatives de march\u00e9 !<\/span><\/b><span style=\"background-color: var(--theme-body-bg-color);color: var(--theme-heading-font-color);font-size: var(--theme-h2-font-size);font-weight: var(--theme-heading-font-weight)\"><\/span><\/p><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-74e3df9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"74e3df9\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e8b66cd\" data-id=\"e8b66cd\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d326de9 elementor-widget elementor-widget-text-editor\" data-id=\"d326de9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Le montant des loyers pay\u00e9s par les entreprises locataires de bureaux est \u00e9troitement li\u00e9 \u00e0 l\u2019\u00e9volution de l\u2019indice ILAT en raison de la fameuse clause dite \u00ab\u00a0d\u2019\u00e9chelle mobile\u00a0\u00bb ins\u00e9r\u00e9e dans les baux commerciaux. Il s\u2019agit en effet d\u2019une clause selon laquelle le locataire (Preneur) et le propri\u00e9taire (Bailleur) s\u2019accordent sur une r\u00e9vision automatique du loyer au cours du bail selon une p\u00e9riodicit\u00e9 fix\u00e9e qui est g\u00e9n\u00e9ralement annuelle. Ainsi, \u00e0 la date anniversaire du bail, les loyers sont tr\u00e8s souvent r\u00e9ajust\u00e9s \u00e0 la hausse &#8211; comme \u00e0 la baisse le cas \u00e9ch\u00e9ant &#8211; dans les m\u00eames proportions que l\u2019\u00e9volution de l\u2019indice ILAT.<\/p><p>Cons\u00e9quence\u00a0: nous assistons \u00e0 une importante d\u00e9corr\u00e9lation entre les valeurs locatives du march\u00e9 et les loyers factur\u00e9s aux entreprises locataires par leurs bailleurs. Ces \u00e9carts tendent m\u00eame \u00e0 constituer un v\u00e9ritable foss\u00e9 dans la mesure o\u00f9 les valeurs locatives de bureaux s\u2019essoufflent actuellement dans un march\u00e9 affect\u00e9 par la brutale chute des investissements et l\u2019augmentation de la vacance, c\u2019est-\u00e0-dire des locaux libres ne trouvant pas preneur.<\/p><p>Ainsi, une entreprise dont le loyer facial annuel \u00e9tait de 200 K\u20ac HT en octobre 2021 se verra appliquer un loyer de 224 K\u20ac HT \u00e0 compter d\u2019octobre 2023, soit une hausse de 12%, alors que les loyers de march\u00e9 ont globalement stagn\u00e9 sur cette m\u00eame p\u00e9riode (sauf dans quelques rares secteurs d\u2019exception).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-1706965 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1706965\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-10637e2\" data-id=\"10637e2\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a3a93d4 elementor-widget elementor-widget-heading\" data-id=\"a3a93d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><p><b><span style=\"font-size:16.0pt;line-height:107%\">Quel comportement adopter : r\u00e9signation ou action ?<\/span><\/b><span style=\"background-color: var(--theme-body-bg-color);color: var(--theme-heading-font-color);font-size: var(--theme-h2-font-size);font-weight: var(--theme-heading-font-weight)\"><\/span><\/p><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-section elementor-top-section elementor-element elementor-element-ac004a7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ac004a7\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-8a9bdfa\" data-id=\"8a9bdfa\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-31cbde2 elementor-widget elementor-widget-text-editor\" data-id=\"31cbde2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour autant, il y a-t-il moyen d\u2019agir\u00a0? Les entreprise locataires qui subissent ces fortes augmentations de loyer doivent-elles se r\u00e9signer ou peuvent-elles agir pour revenir sur des montants de loyers plus coh\u00e9rents et justes\u00a0?<\/p><p>Heureusement des actions et recours sont possibles. Toutefois la solution retenue et la m\u00e9thode employ\u00e9e diff\u00e8rera selon chaque situation.
